Terms of Service

By using phzr.io, you agree to these terms. If you don't agree, please don't use the site. In these terms, "I" and "me" mean PHZR Tech Solutions LLC, a Michigan limited liability company.

You're welcome to browse, read, and contact me through this site. Please don't:

• Use the site for anything illegal or harmful
• Try to break, overload, or gain unauthorized access to the site or its systems
• Send spam or automated submissions through the contact form
• Copy the site's content or design for commercial use without permission

The site describes my services and pricing, but it isn't a contract. Paid work, including Tech Care Plans, websites, and automation projects, is covered by a separate written agreement or proposal. If that agreement conflicts with these terms, the agreement wins.

I keep pricing on this site accurate and up to date, but it can change. The price in your signed proposal oragreement is the one that applies. Tech Care Plans start with a 6-month term (12 months for Custom Care), as set out in your signed agreement. Tech Care Plans are available only in West Michigan. On-site service is included within about 45 minutes of Rockford, Michigan; elsewhere in West Michigan, plans include remote support and scheduled on-site visits, which carry a travel fee.

The text, graphics, logos, and design of this site belong to PHZR Tech Solutions LLC unless noted otherwise. Ownership of work I create for clients is covered in each client agreement.

• AI assistance in deliverables: Some deliverables may be created or improved with AI tools. All are reviewed by a person before delivery.
• No guarantee of AI accuracy: AI-assisted content can contain errors. PHZR Tech Solutions LLC is not liable for outcomes resulting from reliance on AI-assisted deliverables without independent verification.
• Client data: I use business-grade AI tools that do not train on the information I provide, and I never enter credentials, payment or government ID numbers, protected health information, or privileged legal materials into any AI tool. Clients may request that specific information be excluded from AI tools.
• Evolving technology: The AI tools I use may change over time. I'll notify clients of material changes that affect their engagements.
• Order of precedence: These Terms govern use of this website. Services are governed by the signed agreement for each engagement; if the two conflict, the signed agreement controls.

For clients subject to regulations such as the FTC Safeguards Rule, IRS Publication 4557, or state insurance data security laws, I implement and document the technical security controls described in your signed agreement. My role is limited to that technical work.

• You own your compliance program: deciding which laws apply to you, risk assessments, written policies (including your WISP), designating your Qualified Individual, staff training, and any regulatory filings or notifications.
• What I'm not: a law firm, auditor, assessor, or your Qualified Individual or security officer. I don't give legal advice, certify compliance, or guarantee the outcome of any audit, examination, or questionnaire.
• Incident notice: I'll notify you promptly after I confirm a security incident affecting systems I manage, within the timeline in your signed agreement. Notifying regulators, customers, or carriers remains your responsibility.
• Extra compliance work: audit or examiner requests, security questionnaires, and documentation beyond what your plan includes are billed as additional work.

PHZR Tech Solutions LLC is a one-person business. That's what keeps service personal, and it also shapes what I can commit to:

• Hours and response times: support is provided during my posted business hours. Response times on this site are targets, not guarantees, unless your signed agreement states otherwise. I don't provide on-call coverage or guaranteed after-hours response.
• Automated monitoring: devices on an IT Care Plan are monitored 24/7 by automated tools that generate alerts. Alerts are reviewed and acted on during business hours. Automated monitoring doesn't mean a person is watching or responding around the clock, and monitoring tools can miss or delay some issues.
• Time off: I give clients advance notice of planned time off. During illness, emergencies, or time away, I'll respond as soon as I reasonably can.
• Your part: timely access to systems and people, accurate information, current software licenses, and reasonable follow-through on security recommendations. Delays or problems caused by missing access or declined recommendations aren't my responsibility.
• Third-party services: outages, changes, or data loss at vendors such as Microsoft, Google, hosting providers, or internet providers are outside my control, and their own terms apply.
• Backups and security: I work to reduce risk, but no setup can prevent every breach, failure, or data loss, and I can't guarantee that every file can be recovered.

This site may link to other websites and services, like booking tools or review sites. I don't control them and I'm not responsible for their content or privacy practices.

The site and its content are provided "as is." Information here is general and isn't professional advice for your specific situation until we've talked it through. I don't guarantee the site will always be available or error-free.

To the fullest extent allowed by law, PHZR Tech Solutions LLC isn't liable for indirect, incidental, or consequential damages, including lost profits, lost data, business interruption, or regulatory fines, that come from using this site or my services. Unless your signed agreement says otherwise, my total liability for paid services is limited to the fees you paid me in the 3 months before the claim.

These terms are governed by the laws of the State of Michigan. Any dispute will be handled in the state or federal courts located in Kent County, Michigan.

I may update these terms from time to time. When I do, I'll change the effective date at the top. Continuing to use the site means you accept the updated terms.
